Terms & Conditions

 

1. DEFINITIONS

1.1 “Agreement” means the entire content of this Terms and Conditions, any Proposal documents, together with any other supplements, exhibits, schedules or attachments herein.

 

1.2 “Laroja Creative”, “Laroja” or “Provider” means Lavinia Nastas t/a Laroja Creative of 3/22 Daley Street, Yokine WA 6060.

 

1.3 “Client” means a person/s or company who engages Laroja Creative for design and related services.

 

2. WORK ACCEPTANCE

 

2.1 You, the Client, agree to return a signed and dated copy of the quote estimate supplied by Laroja Creative before commencement of any work. You, the Client, also agree to return a signed and dated copy of any final proofs supplied by Laroja Creative before completion of work.

 

3. QUOTATION & CHARGES

 

3.1 All quotations are provided by Laroja Creative are free of charge and are valid for 30 days from the date of issue. Quotations that are not accepted within the time identified may be subject to amendment. All quoted are priced in Australian Dollars. Additional work which is outside the original scope and not provided for in the original quotation, is charged at an additional hourly rate at Laroja Creative's discretion, invoiced in minimum 15 minute blocks.  

 

4. PAYMENT

 

4.1 The Client agrees to pay a non-refundable 50% deposit before commencement of work due immediately.. The client also agrees to pay the invoiced amount in full, or remainder of prior to releasing the high resolution digital files, and/or supplying files for offset or digital printing and websites. The Client is responsible for all debt collection fees, legal fees and court fees that may be incurred as a result of the client’s failure to pay invoices within 7 calendar days of date of issue.

5. DESIGN AND COPYRIGHT OWNERSHIP

5.1 Any artwork designed by Laroja Creative will remain the property of the Laroja Creative.  A copy of the flattened artwork may be provided upon request of the Client on completion of payment.  

 

5.2 Laroja Creative owns all Copyright to all artwork designed for the Client. Copyright may be sold to the Client at a fee of an amount at Laroja Creative’s discretion. In the change of ownership of Copyright, the Client agrees to allow Laroja Creative the right to use the artwork in any form of portfolio.

 

6. LIABILITY

 

6.1 It is agreed that all work and materials provided by Laroja Creative for the Client, will be free and clear of all liens and encumbrances subject to 5.2 in the Agreement. It may be lawfully used by the Client without infringing upon the rights of others, any copyright trade secret patent or trademark right of any third party. The client agrees to indemnify and keep indemnified Laroja Creative and its personnel from and against all claims, proceedings, expenses, costs (including legal costs), damages, losses or obligations of whatever nature including but not limited to consequential losses either directly or indirectly arising from the services provided.

 

7. ETHICS

 

7.1 Laroja Creative will not design any sexual or racial material, upon Laroja Creative's discretion.
